Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the HIGH-CLASS SAFARIS KENYA website and services. By accessing our website or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our website or use our services.

2. Booking and Payment

2.1 Booking Process: All bookings are subject to availability and confirmation. A booking is confirmed once we have received the required deposit or full payment and issued a written confirmation.

2.2 Deposits: A non-refundable deposit of 30% of the total safari cost is required to secure your booking. The remaining balance must be paid at least 30 days before the safari start date.

2.3 Payment Methods: We accept payments via bank transfer, credit card, and mobile money. All payments must be made in the currency specified in your invoice.

2.4 Price Changes: We reserve the right to adjust prices due to factors beyond our control, such as currency fluctuations, government actions, or increases in park fees. Any price changes will be communicated before final payment is due.

3. Cancellations and Refunds

3.1 Cancellation by Client: Cancellations must be made in writing. Refunds are subject to the following schedule:

  • More than 60 days before safari: Full refund minus deposit
  • 30-60 days before safari: 50% refund minus deposit
  • Less than 30 days before safari: No refund

3.2 Cancellation by HIGH-CLASS SAFARIS KENYA: We reserve the right to cancel a safari due to unforeseen circumstances such as natural disasters, political instability, or insufficient participants. In such cases, you will receive a full refund or the option to transfer to another safari.

3.3 No-Show: No refunds will be provided for no-shows or unused services once the safari has commenced.

4. Safari Conduct and Responsibilities

4.1 Client Responsibilities: Clients are responsible for:

  • Having valid travel documents, including passports, visas, and health certificates
  • Obtaining appropriate travel insurance covering medical emergencies, trip cancellation, and personal belongings
  • Following safety instructions provided by guides and staff
  • Respecting wildlife, local cultures, and the environment

4.2 Behavior: We reserve the right to refuse service to anyone whose behavior is deemed inappropriate or disruptive. No refunds will be provided if a client is asked to leave a safari due to inappropriate behavior.

4.3 Health and Fitness: Clients must inform us of any pre-existing medical conditions or special requirements at the time of booking. Some safaris require a minimum level of fitness, and we reserve the right to refuse participation if we believe a client's health or safety may be at risk.

5. Liability and Insurance

5.1 Limitation of Liability: HIGH-CLASS SAFARIS KENYA is not liable for any injury, loss, damage, accident, delay, or irregularity that may be caused by defect of any vehicle, weather conditions, or through the acts or defaults of any company or person engaged in conveying clients or carrying out arrangements for the safari.

5.2 Insurance: We strongly recommend that all clients obtain comprehensive travel insurance covering medical emergencies, evacuation, trip cancellation, and personal belongings.

6. Photography and Marketing

6.1 Photography: We reserve the right to take photographs during safaris for promotional purposes. By participating in our safaris, clients grant us permission to use such photographs unless explicitly stated otherwise.

6.2 Social Media: We encourage clients to share their safari experiences on social media. By tagging us or using our hashtags, you grant us permission to reshare your content.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes indicates your acceptance of the modified Terms.
